Ground Truth Agriculture Inc. (“GTAI”, “we,” “us” or “our”) are committed to maintaining our customer's privacy and the security of personal information.  This policy explains our practices as they relate to the collection, retention, use, and destruction of personal information. We’ve tried to keep it simple, but there might be some confusing language. If you’re unsure of the meaning of anything, please ask us. 

This privacy policy (the "Policy") explains: 

 (a) The type of personal information that we collect, and why we collect it;  

 (b) How that personal information is used; and 

 (c) The choices that we have regarding how to update information. 

Capitalized words and phrases used in this document but not defined herein have the meanings given in the Terms of Service, which incorporates this Policy by reference. 

Personal Information We Collect 

The information we collect from you, or from your use of our products, functionality and services, including without limitation, (collectively, the “GTAI Offerings”) is generally in one or more of the following categories: 

(i) We collect and store all of the User Content that you upload into your Account through the GTAI Offerings. Your User Content is yours. We store this data to keep it safe and synced to all your devices and equipment. How we use this information is detailed in this Policy and our Terms. 

(ii) In order to use the GTAI Offerings, we require you to sign up for an Account. Through this process we ask you for personal information, such as your name, address, land location, payment information, and email address. This information is associated with your Account. This information is given by you as a necessary part of accessing the GTAI Offerings. Sometimes, this information may be provided to a third party because it is necessary for a third party to access the information to provide the GTAI Offerings. In those instances, you are giving us the consent to provide that information to the third party. 

(d) We may collect information you submit to us through your use of the GTAI Offerings and use of our website outside of the Account creation process, including inquiries, support tickets, the filling of forms, employment applications sent to us using submission forms, and other requests. We also acquire personal information as a result of the transactions that you participate in, such as the type and nature of the GTAI Offerings purchased, method of payment preferences, and customer communication preferences. This information is used by us to respond to your inquiries, process your purchases and other requests, and to process your employment applications. 

(i) Like most websites and other Internet services, we may collect certain technical and device information about your use of the GTAI Offerings and our website. Such information may include your Internet protocol address, information about your device, browser and operating system, and the date and time of your interaction. 

(ii) We may also use “cookies” or enlist third party services which use cookies to track your preferences and activities on our website. Cookies are small data files transferred to your computer’s hard-drive by a website. They keep a record of your preferences, making your subsequent visits to the site more efficient. Cookies may store a variety of information, including the number of times that you access a site, your registration information and the number of times that you view a particular page or other item on the site. The use of cookies is a common practice adopted by most major sites to better serve their users. Most browsers are designed to accept cookies, but they can be modified to block cookies. See your browser’s help files for more information. You should note, however, that without cookies some of our website’s functions may not be available. 

Your Consent to Collection, Use and Disclosure 

We collect, use and disclose your personal information with your consent or as permitted or required by law. How we obtain your consent (i.e. the form we use) will depend on the circumstances, as well as the sensitivity of the information collected. Subject to applicable laws, your consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question. If you choose to provide personal information to us, we assume that you consent to the collection, use and disclosure of your personal information as outlined in this privacy statement. 

Typically, we will seek your consent at the time your personal information is collected. Where we want to use your personal information for a purpose not previously identified to you at the time of collection, we will seek your consent prior to our use of such information for this new purpose. 

You may withdraw your consent to our collection, use or disclosure of your personal information at any time by contacting us using the contact information in the “Contact Us” section below. However, before we implement the withdrawal of consent, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services. 

If you provide personal information about another individual to us, it is your responsibility to obtain the consent of that individual to enable us to collect, use and disclose his or her information as described in this privacy statement. We will hold this personal information about another individual under the same standards that we hold your personal information. 

How We Use Your Personal Information 

We only collect, use and disclose your personal information with your consent. This consent may be express or implied. 

We will use your personal information in association with your Account to provide you with the GTAI Offerings and personalize the GTAI Offerings to you, which will include such basic features as linking your GTAI Equipment to your Account and name. If we have collected your personal information through your use of the GTAI Offerings, and it can be used to improve your experience in using the GTAI Offerings, then we presume that we have implied consent. We require payment information in order to process any subscription or content purchases that you elect to purchase through the GTAI Offerings. 

We use information collected from cookies and other technologies to improve your user experience and the overall quality of the Service. As you use the GTAI Offerings, this technology tracks your interaction and provides us with information on how you use the GTAI Offerings. We then use this information to improve your user experience. Some of these activities are automatic, whereas other are done manually by our IT professionals and developers to respond to inquiries and other requests. These activities may be done at an individual level, but they also may be done on an aggregated and anonymized basis. To the extent that we are able, we will anonymize data before it is processed for development of the GTAI Offerings. 

If you submit personal information to us for a specific purpose, for example, in response to a job posting, as a support ticket, or through a survey or questionnaire about the GTAI Offerings, we will use your personal information to process that interaction between us and you. Depending on the nature of the submission (e.g. a survey), we may further process and use that information for qualitative and quantitative analysis to develop our GTAI Offerings and offer a better product. 

In limited circumstances, it may be necessary to use personal information that you have provided to us to investigate legal claims made against us. 

We may use your personal information and other information for purposes for which we have obtained your consent, and for such other purposes as may be permitted or required by applicable law. We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy. 

We do not use the information we collect to provide advertising of third party products and services or targeted advertising of products and services across third party websites or service offerings. 

How We Share Your Personal Information 

We rely on third party services providers to perform a variety of services on our behalf, such as hosting, data storage and processing service providers, and research and analytics providers. 

If we provide your information to service providers, then we require that the service providers maintain the confidentiality of your personal information and keep your personal information secure. We also require that they only use your personal information for the limited purposes for which it is provided. When our service providers no longer need your personal information for those limited purposes, we require that they dispose of the personal information. In some circumstances, we may permit our service providers to retain aggregated, anonymized or statistical information that does not identify you. We do not authorize the service providers to disclose your personal information to unauthorized parties or to use your personal information for their direct marketing purposes. Additionally, we may use and disclose your information when we believe such use or disclosure is permitted, necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce the terms of the agreements for our products and services; (e) to protect our operations or those of any of our affiliates or subsidiaries; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. 

If we otherwise intend to disclose your personal information to a third party, we will identify that third party and the purpose for the disclosure, and obtain your consent. 

Retention of Personal Information 

We will retain your personal information only for as long as necessary to fulfill the purposes for which that personal information was collected and as permitted or required by law. When your personal information is no longer required we will destroy it in a secure and confidential manner. 

Information Security 

We have implemented physical, organizational, contractual and technological security measures with a view to protecting your personal information and other information from loss or theft, unauthorized access, disclosure, copying, use or modification. We have taken steps to ensure that the only personnel who are granted access to your personal information are those with a business ‘need-to-know’ or whose duties reasonably require such information. 

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to, on or through our services. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our services or in your operating system. 

What You Can Do 

Just as you play a vital role in ensuring the security of your home and your possessions, you too share in the responsibility for ensuring that your personal information is adequately protected. While we takes strong measures to protect the security and privacy of your information, there are important steps that you should take to help protect your information when accessing our Services. 

To protect your information, you should consider and adopt the following “best practices”: 

  • Never leave your device unattended while using our Service. 

  • Secure or erase files stored on your device so others cannot read them. Most programs store information in non-protected (unencrypted) files to improve performance. These files remain there until erased.  

  • Disable automatic password-save features in the software you use. 

  • Install new security patches as soon as your operating system and internet browser manufacturers make them available.  

  • Install an anti-spyware program. Ensure your anti-spyware is enabled and configured to run daily updates and regular spam scans. 

International Transfer and Storage of Information 

Your personal information may be stored and processed in any country where we have facilities or in which we engage third party service providers. As a result, your personal information may be transferred to countries outside your country of residence, which may have different data protection rules than in your country. While such information is outside of your country, it is subject to the laws of the country in which it is located, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies of such other country, pursuant to the laws of such country. 

Children’s Information 

Our website is not intended for children under the age of 18, and we do not knowingly collect personal information from children under the age of 18. Children under the age of 18 should not use our GTAI Offerings and should not provide us with their personal information. If we discover that we have inadvertently been provided with personal information of a person under the age of 18, we will delete it as soon as possible. 

Privacy Statement Updates 

This Policy is current as of the “updated” date which appears at the top of this page. We may modify this Policy from time to time. When changes are made to this Policy, they will become immediately effective when published in a revised Policy posted on our Website, unless otherwise noted. We may also communicate the changes through other means. We will not reduce your rights under this Policy without your explicit consent. We will also keep prior versions of this Policy in an archive that you can review. By submitting your personal information to us through the Service, or by otherwise accessing or using our Service after we publish or communicate a notice about the changes to this Policy, you consent to our collecting, using and disclosing your personal information as set out in the revised Policy.
